Terms of Use

You must be at least 13 years old (or the minimum digital-consent age in your country). By using Kaya you confirm you meet this requirement.

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Kaya for your own non-commercial language learning, subject to these Terms and the applicable app store's licensed-application rules.

You're responsible for activity under your account and for keeping your credentials secure. You can use Kaya without an account; if you create one, give accurate information and keep it up to date.

THRIVE is an auto-renewing subscription offering additional features.

• Payment is charged to your app store account (Apple ID or Google Play account) at confirmation of purchase.
• The subscription renews automatically for the same period unless you cancel at least 24 hours before the current period ends.
• Your account is charged for renewal within 24 hours before the period ends.
• Manage or cancel anytime in your app store's subscription settings (App Store or Google Play).
• Prices may vary by region and may change with notice as permitted by the app store. Refunds are handled by the app store under its policies.

Free features (SURVIVE) remain free.

Don't misuse Kaya. In particular, don't: break the law; reverse-engineer, scrape, or overload the service; resell or commercially exploit content; or use it to harm others. We may suspend or terminate access for violations.

Kaya provides language learning, translations, pronunciation and an AI conversation partner for educational purposes. Translations and AI responses may be inaccurate or incomplete and can vary by context. Do not rely on Kaya for emergencies, medical, legal, financial, safety, or other critical decisions. Always verify important information with a qualified human. Kaya is provided as a study aid, not professional advice.

Content you create or save (e.g. trips, notes, recordings you submit for transcription) remains yours. You grant us a limited licence to process it solely to operate the features you use (for example, sending a phrase to a voice service, or a clip to a transcription service). Kaya, its design, content, and trademarks are owned by us or our licensors and are protected by law. These Terms don't transfer any ownership to you.

Kaya relies on third-party providers (e.g. hosting, AI, speech, and text-recognition services) to deliver some features. Their processing of data is described in our Privacy Policy. We're not responsible for third-party services outside our control.

Kaya is provided “as is” and “as available”, without warranties of any kind, to the maximum extent permitted by law. We don't warrant that the app will be uninterrupted, error-free, or that translations/AI output will be accurate.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on translations, AI output, or app availability. Our total liability for any claim is limited to the amount you paid us for Kaya in the 12 months before the claim (or, if you used only free features, USD $0).

For apps obtained through the Apple App Store, these Terms are between you and Kaya only, not Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for Kaya. If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for product liability, legal/regulatory compliance, or third-party IP claims relating to the app. You represent that you are not in a US-embargoed country or on a US prohibited-parties list. You must comply with applicable third-party agreements (e.g. your wireless data plan). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

For apps obtained through Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the app or its content.

You may stop using Kaya and delete your account anytime (Settings → Delete account). We may suspend or end access if you breach these Terms. Sections that by their nature should survive (e.g. 6, 8, 10, 11) survive termination.

We may update these Terms; we'll post the new “Last updated” date and, for material changes, notify you in the app. Continued use means you accept the changes.

These Terms are governed by the laws of Singapore, without regard to conflict-of-law rules. Courts of Singapore have jurisdiction, subject to any mandatory consumer protections in your country of residence.
